Welcome to the Smilebikes Ltd terms and conditions page. These terms and conditions apply to the Smilebikes Main website [www.smilebikes.co.uk] and the Smilebikes Online Shop website [www.smilebikes-shop.co.uk]. By placing an order you agree to the terms and conditions set out on this page. We reserve the right to change the Terms and Conditions at any time and it is your responsibility to check regularly before ordering. This does not affect your statutory rights.

We operate our business in line with CRA 2015 & CCR 2014 regulations and laws.

LIMITATION OF LIABILITY

We shall not be liable for incidental or consequential damages or expenses. This includes, but is not limited to, damage to property, lost income, profits, economic or commercial losses and third parties claims. We have no liability to you for any delay in the delivery of products ordered.

PLACING AN ORDER

By placing an order on our website, you are offering to purchase a products subject to the following terms and conditions.

All orders are subject to availability and confirmation of the order price. We reserve the right to review or refuse orders which are considered illegitimate. If we need to cancel your order for any reason, we will let you know by email and issue a full refund.

PRICES

Whilst we try and ensure that all details, descriptions and prices which appear on this website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled and issue a full refund.

RETURN OF ITEMS

If fir any reason you are unhappy with your order, Under the Consumer Contracts Regulations of 2014, you have the right to cancel your order up to 14 days from the day you receive your goods if you are an online, mail or telephone order customer.

If you wish to return your bike / item please note:

• Bikes/Items must be returned complete including the charger, accessories and manuals and in their original box (if applicable)
• Bikes/Items must be in an unused condition
• Bikes must have no more than 5 ‘test’ miles completed

Any bikes that do not meet this criteria will be considered on a case-by-case basis and a restocking fee may apply at our discretion.

For Distance (Online) Selling:

You are allowed to return an item if you simply change your mind. You have the right to cancel at any time from the moment you place your online order, and up to 14 days from the day you receive the goods. You then have a further 14 days from the date you notify us of your order cancellation to return the goods.

Customers are responsible for any charges for returning a bike/item which is not damaged or faulty. If we arrange collection of a bike, the delivery charge may be deducted from any refund we make. Please contact us to obtain a quote.

If your bike develops a fault, please contact us by email [info@smilebikes.co.uk] and one of our team will get back to you with a resolution.

For Faulty Goods:

Under the Consumer Rights Act of 2015 you have an early right to reject goods that are unsatisfactory quality, unfit for purpose or not as described, and get a full refund up to 30 days you took ownership of the goods. You are not liable for return postage.

WARRANTY

If your bike develops a fault, please contact us by email [info@smilebikes.co.uk] and one of our team will get back to you with a resolution.

All of our new products are offered with a manufacturers warranty. Please consult the manufacturers warranty statement to confirm extent of cover and exclusions. Common exclusions are often as follows:

• Normal wear and tear
• Commercial use
• Damage to products due to being improperly installed, handled or repaired
• Products that have been modified, poorly maintained or neglected
• Product damage from anything other than defects in product material

Used, clearance, ex-demo or discounted products may be subject to a reduced warranty. Please confirm at the time of purchase.

Manufacturer warranties

Bosch: The Bosch warranty period is 2 years and / or up to 500 full charge cycles on batteries. 

Raleigh

Haibike

Yamaha: The Yamaha warranty period is 24 months

Lapierre

Mahle: Mahle E-Bikes come with a 2 year guarantee which includes all of the components in the X35 and X20 drive systems.

Wisper: Two year warranty on electrical and bike parts with five years on frames.

DELIVERY

Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are subject to any delays resulting from postal delays. Generally, please allow up to 5 days for pre-delivery inspection & dispatch and a further 3-5 days for courier delivery of most items. For personal delivery by Smilebikes staff, we will contact you directly to arrange a continent date and time.

We will do our best to get all orders dispatched as quickly as possible. We have no liability to you for any delay in the delivery of products ordered. You have the right to cancel delayed orders at any time and get a refund prior to the item being dispatched.

PAYMENT

In order to place an order with us you must be over 18 years of age. We retain the right to refuse any request made by you. If your order is accepted we will inform you by email. When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card, or bank account used to place your order and that there are sufficient funds to cover the cost of the goods.

GOVERNING LAW AND ARBITRATION

Smilebikes Ltd Terms and Conditions shall be governed by and construed in accordance with the law of England and Wales.

TAXES

Where applicable, prices are inclusive of VAT. Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the ‘Total section of the checkout process’.

RIDE TO WORK

Orders placed through Ride to Work schemes are processed manually by Smilebikes staff. Please submit your enquiry using the Ride to Work contact form on our Ride to Work page.

Ride to Work orders may be subject to an additional fee and exclude some products, please contact us to discuss ordering this way.
